Content Submission Terms

These terms apply when you send us photos, video or audio ("Content") through any Wavy upload link, form or submission page, or when you tag or send us Content and we ask you to agree to these terms. Please read them before you submit anything.
1. Who we are
"Wavy", "we" and "us" means WAVY GROUP LIMITED, a company registered in England and Wales under company number 14595104, with its registered office at 101 New Cavendish Street, 1st Floor South, London, United Kingdom, W1W 6XH. You can contact us at info@feelwavy.com.
2. The licence you grant us
By submitting Content, you grant Wavy a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, transferable and sub-licensable licence to host, store, reproduce, edit, crop, resize, re-time, caption, subtitle, add music or graphics to, combine with other material, publish, broadcast and distribute the Content, in whole or in part, in any media now known or developed in the future.
This licence is granted for the maximum period permitted by law and continues after you stop dealing with us.
3. Where we may use it
We may use the Content anywhere we communicate about Wavy, including but not limited to:
- our organic social media channels and those of our brand partners;
- paid advertising on any platform, including Meta, TikTok, YouTube, Google and Pinterest;
- our website, product pages, landing pages and customer reviews;
- email and SMS marketing;
- packaging, print, point of sale and in-store display;
- press, PR and editorial material;
- the marketing channels of retailers, stockists and distributors who sell Wavy products.
4. What you are confirming
By submitting Content, you confirm that:
- you are 18 years of age or over;
- you created the Content, or you otherwise hold all rights necessary to grant the licence in section 2;
- everyone who is identifiable in the Content has agreed to appear in it and to our use of it on these terms, and any person under 18 who appears has the consent of their parent or guardian;
- the Content does not contain music, artwork, logos, trade marks, footage or other material belonging to someone else that you do not have the right to license to us;
- the Content is not defamatory, obscene, offensive or otherwise unlawful, and using it will not breach anyone else's rights or any law.
Background music is the most common issue with event footage. If recognisable commercial music is audible in your Content, please tell us when you submit it.
5. Your name, likeness and credit
You consent to us using your name, image, voice, likeness and social media handle in connection with the Content. We may credit you, but we are not obliged to, and we may use the Content without attribution. To the fullest extent permitted by law, you waive any moral rights you have in the Content.
6. No payment and no obligation to use
You will not receive any payment, fee or other consideration for the Content or for any use we make of it. We are under no obligation to use the Content, and we may stop using it at any time.
7. Withdrawing your permission
If you change your mind, email info@feelwavy.com and we will stop using your Content in new material within a reasonable period.
Please note that we cannot remove Content from advertising that is already running, material that has already been printed or manufactured, content that third parties have already published or shared, or copies that other people have already downloaded or reposted.
8. How we handle your personal data
We process the personal data you give us when submitting Content, including your name, email address and social media handle, so that we can manage submissions, verify permission and contact you about how your Content is used. We do this on the basis of our legitimate interests in operating and marketing our business, and on the basis of your consent where required.

9. Changes to these terms
We may update these terms from time to time. The version that applies to your Content is the version published on this page at the time you submitted it, and any changes we make will not apply retrospectively to Content already submitted. The version number and date at the top of this page tell you which version is currently in force.
10. Liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded. Subject to that, we are not liable to you for any loss arising from our use or non-use of your Content.
11. Governing law
These terms and any dispute arising from them are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
